EB-5 Visa Applications on the rise in Vietnam and India

EB-5 Visa Popularity has led to a backlog in China but other countries are still open.

EB-5 Visa’s have a yearly limitation of 10,000 visas and there is currently no EB-5 backlog for citizens of any country other than China. For Chinese applicants a person must have an approved EB-5 I-526 petition with a priority date of July 1, 2014 to qualify for a visa number for immigration.

When citizens from one country apply for over 7% of the 140,000 annual employment based visas the Visa Bulletin creates a cut-off date which bottlenecks the overwhelming amount of applications. The China cutoff date for applications will move forward slowly but the popularity of the EB-5 immigration program has led to thousands of applications in the backlog for China.

Vietnamese EB-5 Visa Applications and Indian EB-5 Visa Applications are Increasing

Popularity of the EB-5 visa program has been increasing in other countries as well. Both Vietnam and India are rapidly increasing the amount of applications and will soon be affected by cut off dates. India is expected to reach the point of needing a cut off date by 2020. Vietnam has such a high demand for visas currently that the State Department believes they will experience a cut off date of 2014, by as early as September 2018. The processing time for applications does not look like it will be affected dramatically by the Vietnamese cutoff date as the applications will only be delayed by about a month.
