New Commercial Enterprise Not Associated With an EB-5 Regional Center

For a new commercial enterprise that is not associated with a regional center, the EB-5 Program provides that the full-time positions must be created directly by the new commercial enterprise to be counted. This means that the new commercial enterprise (or its wholly-owned subsidiaries) must itself be the employer of the qualified employees who fill the new full-time positions.

Taken directly from USCIS’ EB-5 Adjudications Policy Memorandum posted on February 14, 2013.
